Our Terms of Service and Privacy Policy were written in early 2024, before most of what Sargo is today existed. As of 12 June 2026, both have been rewritten from scratch. Here is what actually changed, in plain language.
Terms of Service — 18 sections instead of 38
The new Terms describe the marketplace as it really works. Sargo is non-custodial: your stablecoins sit in an on-chain escrow contract, never with us, and your shillings move directly between you and your counterparty. We are not a party to your trade, not a payment processor, and not a custodian. Disputes are settled by evidence — zero-knowledge payment proofs and order records, with 48-hour response windows — and once escrow releases, release is final. Fees are always shown before you commit. The Terms are governed by the laws of Kenya, and Sargo Ltd is identified plainly as a company registered in England and Wales.
Privacy Policy — honest about both jurisdictions
Because Sargo Ltd is a UK company serving people in Kenya, the new policy honours both UK GDPR and Kenya's Data Protection Act, 2019, with complaint routes to both the ODPC and the ICO. It is honest about things the old policy was not: identity verification involves biometric processing (your selfie and liveness check), carried out with your explicit consent through licensed providers. Your counterparty must see the payment details you provide for an order — that is what peer-to-peer means. Public blockchains are permanent, so erasure rights apply to what we hold off-chain, not to the ledger. Verification and transaction records are kept for seven years, as anti-money-laundering law requires. And this website sets no cookies and runs no analytics.
